FANTASY TENNIS LEAGUE COMPETITION 2017

Fantasy Tennis League is an online fantasy sports community and game of skill. For the purpose of this promotion the following definitions apply:

“Promoter” means Tennis Australia Limited (ABN 61 006 281 125) of Private Bag 6060 Richmond South, Vic 3121.

“Promotion” means the Fantasy Tennis League competition, conducted during the course of the 46 weeks of the 2017 ATP, WTA and ITF tennis season;

The following tournaments are included in this season: Grand Slams, ATP Masters 1000, ATP Masters 500, ATP Masters 250, ATP World Tour Finals, WTA Premier, WTA International, WTA Finals. Where the Promoter is unable to provide data from a tournament that event will not be included in the game schedule.

“Promotion Period” means the period commencing at 12:01am Australian Eastern Daylight Savings Time (“AEDST”) on 16 January 2017 and closing on 11.59pm Australian Eastern Standard Time (“AEST”) on 21 November 2017. Entrants are responsible for determining the corresponding time zone in their respective jurisdictions.

“Website” means fantasytennisleague.com.

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions and the Website Terms of Use. In the event of any inconsistency, these Terms and Conditions shall prevail. The laws of Victoria, Australia apply to this Promotion to the exclusion of any other law. Participants submit to the exclusive jurisdiction of the courts of Victoria, Australia.

Eligibility to Enter and Receive Prizes

  1. Persons who are:
  • residents of the Central African Republic, Crimea and Sevastopol, Democratic Republic of Congo, Eritrea, Guinea-Bissau, Iraq, Iran, Lebanon, Libya, Montenegro, Myanmar, North Korea, Russia, Serbia, Somalia, South Sudan, Sudan, Syria, Ukraine, Yemen, and Zimbabwe;
  • residents of Australian sanctioned or embargoed countries;
  • ordinarily resident in Australian sanctioned or embargoed countries; or
  • otherwise prohibited by applicable export controls and sanctions programs,

are not eligible to participate in the Promotion.

All eligible Participants may be awarded prizes, except for Participants who are ordinarily residents of Austria, Brazil, France, Germany, Hong Kong, Italy, Mexico, Netherlands, Northern Ireland, Philippines, Quebec, Republic of Ireland, Spain, Sweden, Turkey, and United Arab Emirates.

If any prize winner is under the age of 18 (as of the determination date) the prize may only be accepted by a parent or legal guardian on behalf of the winner. Without limiting the foregoing, in addition to those residents ineligible to participate above, TA reserves the right to not award prizes that involve the physical delivery of goods to Participants located in territories where it is commercially impractical for the Promoter to deliver such prizes. The Promoter will use its reasonable endeavours to replace any such prizes with a similar value prize, but to the extent permitted by law, the Promoter will not be liable to the Participant for any failure to replace such prize.

Directors, contractors, managers and employees (and their immediate family) of the Promoter or any of its related bodies corporates and agencies (including sponsors) associated with this Promotion are excluded from winning any prizes. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. All Participants and Promotion winners consent to the publication of their name, suburb and state of residence, and agree to participate in reasonable promotional activities as requested by the Promoter from time to time. The Promoter reserves the right to limit the number of Participants in the Promotion at any time for any reason.

Entry

  1. To enter, the Participant must firstly register by completing the online registration process at the Website during the Promotion Period. Participants will be required to (a) choose a nickname/alias to identify their entry; (b) submit the name of their fantasy tennis team; and (c) subject to “Salary Cap Limitations” as detailed on the Website, submit a complete team of 16 players (“Chosen Team”).
  2. Only one registration per Participant (and per email address) may be submitted. Under no circumstances can Participants enter two or more registrations or team entries. Any Participants found to do so will be disqualified from eligibility to win prizes, solely at the Promoter’s discretion. By registering, the Participant agrees to subscribe (or has already subscribed) to receive periodical results and/or reminder emails about the Promotion, notification of new Promotions, and other similar, related newsletters by the Promoter from time to time. The Participant may choose to opt-out of any such newsletters at any time.
  3. If invited to enter a particular league, Participants may enter their details to join that league during the registration process. Alternatively they can create up to ten private or public leagues and invite others to join. If they do not select a league, Participants will automatically be entered into a public league. Subject to a Participant’s eligibility to win a prize, that eligibility will not be affected by whether they join a public league or private league. Rankings as displayed on the Website include the rankings of all Participants, and not only the rankings of Participants that are eligible to win a prize, and therefore should not be relied upon as indication of who will win a prize.
  4. During registration, Participants may refer the Promotion to their friends via email using the refer-a-friend facility on the Website. If a Participant refers a friend, they warrant that they have obtained their friend’s implied or actual consent to do so prior to sending the email. The Participant indemnifies the Promoter against any claims by any third party for the Participant’s failure to do so.

Rules

  1. Participants may replace players in their Chosen Team via the “Trade Page” on the Website, in accordance with any directions. Participants may make a maximum of a THREE trades for any tournament week and 72 during a season. Unused trades in any tournament week are not transferrable and will be forfeited. Player trades must take place prior to the commencement of a particular tournament week to be eligible to be selected for that tournament, and are subject to any Salary Cap Limitations as detailed on the Website. Players traded during the season do not get their aggregate points added or subtracted to the Participant’s total. For sake of clarity, if the player is removed from, or added to the Chosen Team, only the points earned by that player for that Participant, prior to their removal or after their addition from the Chosen Team, in accordance with these Terms and Conditions, count towards the Participant’s total.
  2. After registration, Participants may enter all remaining tournaments that have not been completed. Subject to clause 9, to enter a particular tournament, the Participant must prior to the lockout period for that tournament (as notified on the Website), submit their “Tournament Week Team” comprising of 8 “Starting Players” from their Chosen Team.

Each Participant will be awarded one Automatic Emergency from their remaining 8 bench players in the event that any of the Starting Players do not play in any given tournament week and receive a score of 0 points. The Automatic Emergency will be the lowest scoring player who receives a score greater than 0 from their 8 bench players. The Automatic Emergency score will be automatically added to the total points scored by the participant’s team in any given tournament week. Participants may select a “Team Captain” who will score 50% additional points, and select 3 “Key Players” who will score 20% additional points.

  1. If, after participating in a tournament week, a Participant does not amend their Team, their Team from the previous tournament week as selected by the Participant will be used, regardless of whether or not those players will be playing in the coming tournament week.
  2. Participants will score points based upon the performance of their selected players in their tournament team for the particular tournament week. Points will be awarded (or subtracted) for each performance statistic attributed to that player during the tournament as follows:

Tournament points:

Grand Slam winner: 60 bonus points

Grand Slam runner-up: 36 bonus points

 

ATP Masters 1000 / WTA Premier 5 or Mandatory winner: 40 bonus points

ATP Masters 1000 / WTA Premier 5 or Mandatory runner-up: 24 bonus points

 

ATP 500 / WTA Premier winner: 20 bonus points

ATP 500 / WTA Premier runner-up: 12 bonus points

 

ATP 250 / WTA International winner: 10 bonus points

ATP 250 / WTA International runner-up: 6 bonus points

 

Match points

+ 3 for winning in two sets

 

Set points

– 2 for a doughnut loss (i.e. 6-0)

+ 1 for winning 4 games in a set

+ 1 for each set won

+ 1 for a tiebreak win

 

Game points

+ 0.2 per ace

– 0.2 per double fault

+ 0.2 per first serve return point won

+ 0.1 per second serve return point won

+ 0.5 per break point converted

+ 0.1 per break point saved

12. The Promoter’s decisions in relation to all aspects of this Promotion are final and no correspondence will be entered into, including decisions in relation to the number of points that a Participant may have earned.

 

  1. Rankings of Participants from the last tournament completed and cumulative rankings for all completed Tournament Weeks will appear on the Website as per clause 15 below. Rankings on the Website may not give a true indication of the eventual winner of a prize.

  1. The Promotion is comprised of 11 ‘rounds’. Lockout Time begins at 11:00am local time of the tournament location on the Start Date for each Game Week.

Prizes

  1. Prizes will only be awarded to Participants who are eligible to win a prize in accordance with clause 3. In the event of a tie, the winner will be determined in accordance with clause 15(e) below.
  2. Round Prize Winners:

The Participant who scores the highest number of points from each round will win a Grand Slam prize pack to the value of AUD$100. Round prize winners will be determined by the Promoter at Private Bag 6060 Richmond South, Vic 3121 at 12:00PM AEST on the day after completion of each round (as determined by the round calendar in clause 14 above) during the Promotion Period.

  1. Overall Prize Winners:

The Participant with the highest accumulated number of points at the end of the tennis season (determined to be the end of the ATP World Tour Finals) will win two men’s finals tickets to Australian Open 2018, economy class return flights and two nights accommodation on Saturday 27 January 2018 and Sunday 28 January 2018. The Participant who scores the second highest accumulated number of points at the end of the tennis season will win two finals tickets to an Australian Open Series tournament of their choice including to the 2018 Hopman Cup, Brisbane International, Sydney Apia International and Hobart International. Participants ranked from 3rd to 10th in highest accumulated number of points at the end of the tennis season will each win a $50 electronic gift voucher to the australianopenshop.com to be spent before June 30 2018 (note: the delivery costs of the items purchased with the gift voucher will be borne by the prize winner). The overall prize winners will be determined by the Promoter at Private Bag 6060 Richmond South, Vic 3121 at 12:00PM AEST on 1 December 2017.

  1. Tie Breaking

If there is more than one Participant with the equal highest number of points for the Overall Prizes or a round prize, the Participant with the least amount of trades used will win the prize. Should this fail to break the tie, the Participant with the highest number points achieved for total match wins will win the prize. Should this fail to break the tie, the Participant with the highest number of points achieved for aces will win the prize. Where a tie cannot be resolved by any of the means above, the Participant whose Team was registered the earliest will win.

  1. Unclaimed Prizes

If the Major Prizes are not claimed within two weeks from the Promotion Period close date, the Participant who had the second highest score over the duration of the Promotion Period will receive that prize. If a round prize is not claimed within one month of the completion of the relevant round, the Participant who had the second highest score for that round will receive that prize. The winners, if any, will be contacted by email and phone within 2 business days of being determined and published on the Web Site on 1 December 2017 for 28 days.

  1. Publication of Winners’ Details

Each round prize winner will be notified by email within 2 business days of being determined, using the details provided in their entry, and the name and country of residence of the weekly prize winner will be published on the Web Site on the next Tuesday following the completion of the round for 28 days.

The Overall Prize winners and round Prize Winners will be notified by email, using the details provided in their entry. The name and country of the winner of the Overall Prize will be announced on the Web Site above on 1 December 2017. The Promoter is not responsible for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify prize winners.

  1. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in prize values. Where a prize, or part of a prize, is unavailable for any reason, the Promoter may substitute for that prize (or part) another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in each state and territory, where required. Any taxes which may be payable as a consequence of a winner receiving a prize are the sole responsibility of the winners. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, Participants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market value.
  2. All costs associated with a prize not specifically included in the Prize Details including, but not limited to, any transport costs, transfer costs, meals, taxes, insurance and other ancillary costs are the responsibility of the winner (and their companion/s if applicable).
  3. If a prize includes tickets to an event, all tickets are valid for the date or period as indicated on the tickets. All event tickets are issued subject to the relevant event ticket conditions of sale and entry. If any part of the event is abandoned, called off, varied or postponed for any reason, then at the Promoter’s discretion, the relevant winner (and their companion/s, if applicable) forfeits all rights to attend the relevant event. The Promoter is neither responsible nor liable for any loss or damage suffered in these circumstances.
  4. If a prize involves the winner meeting or attending a function with a celebrity or other public figure, the Promoter will not be liable for the failure of the winner (and their companion/s, if applicable) to meet that person or failure of that person to attend the function, for whatever reason.
  5. If a prize includes domestic or international travel the prize must be booked and completed as specified by the Promoter. Any flights and accommodation constituting part of a prize are subject to booking and availability. Any tickets, passes or vouchers issued as part of the prize are subject to the prevailing terms and conditions of use. They are only valid for use within the stated duration on the tickets, passes or vouchers issued and are not replaceable if lost, stolen or damaged. The Promoter is not responsible for any cancellation, delay or re-scheduling of flights and any costs incurred as a result (including without limitation accommodation costs) will be the sole responsibility of the winner.
  6. The winner (and their companion/s if applicable) will be responsible for meeting all the entry requirements as all as any health or other government requirements for international travel including valid passports, necessary visas, travel authorizations, medical advice and recommended vaccinations and immunisations. Failure to fulfill these requirements may result in the prize being forfeited or any additional costs being incurred at the expense of the winner. The winner (and their companion/s if applicable) agrees to comply with any prevailing terms and conditions of the relevant transport carrier, accommodation provider, service provider, insurance provider and in particular any health, behaviour, age and safety requirements. The Promoter reserves the right, at any time, to verify the validity of entries and Participants (including a Participant’s identity, age and place of residence) and to disqualify any Participant who submits an entry that is not in accordance with these Terms and Conditions or who in the opinion of the Promoter tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  7. All prize winners must as a condition of being awarded a prize, at the Promoter’s request, participate in any marketing and promotional activity (such as publicity and photography) in relation to winning any prize, free of charge. Participants consent to the Promoter using the Participant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products/services supplied by the Promoter.
  8. Incomplete, indecipherable, incorrect or illegible entries will be deemed invalid. Entries containing inappropriate, offensive, derogatory, defamatory or illegal content, as determined by the Promoter will be deemed invalid and may be removed from the Promotion.
  9. If there is a dispute as to the identity of a Participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Participant.

Exclusion of Liability

  1. To the extent permitted by law, the Promoter, its parent companies and/or subsidiaries are not liable for any loss, injury, or damage of any kind suffered or sustained to person or property and including, but not limited to, consequential (including economic) loss arising: (i) by reason of any act or omission, deliberate or negligent, by the Promoter, any of its parent companies and/or subsidiaries, or their servants or agents, in connection with the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to Participants or the prize winners; (ii) due to the game being disrupted or corrupted due to reasons beyond the control of the Promoter; (iii) from the acceptance, possession, use, or misuse of a prize, or from participation in the game or downloading material from the Website; or (iv) as a result of their being any printing or typographical errors in any materials associated with the game. Each winner must sign and return any liability release provided by the Promoter as a condition of any prize being awarded. Failure to return the signed releases will result in the entitlement to the prize being forfeited and the selection of another winner.
  2. Nothing in these official rules affects, nor is intended to affect, any rights a consumer might have which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servants or agents for breach of any such rights is limited to the supplying of the relevant goods or services again.
  3. The Promoter and its associated agencies and companies take no responsibility for the loss of, any damage to or delay in the transit of prize/s due to incorrect or imprecise delivery or contact details provided by an entrant.
  4. To the extent permitted by law, the Promoter makes no representations or warranties as to the quality, suitability or merchantability of any of the goods or services offered as prizes.
  5. The Promoter is not responsible for losses associated with any change in the value of any prizes.
  6. To the extent permitted by law, the Promoter and its associated agencies and companies will not be liable for any loss suffered or sustained for personal injury or death or any loss suffered to personal property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangements for supply, or the supply, of any goods or services by any person to the winner/s and where applicable, to any persons accompanying the winner.
  7. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant who is responsible for interfering or authorizes another to interfere with the entry process or the fairness of the game; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
  8. Any cost associated with accessing the promotional website is the Participant’s responsibility and is dependent on the Internet service provider used.

Privacy

  1. The Participant agrees that the Promoter collects personal information in order to conduct the Promotion, to assist in providing the goods or services the Participant has requested, to process Participant Promotion entries, to improve its products and services, and as otherwise contemplated under these terms and conditions and the tennis privacy policy located at www.tennis.com.au/privacy, which contains information about how Participant’s may access and seek correction of their personal information or complain about a breach of their privacy, and how the Promoter will deal with that complaint. The Promoter may, (either directly or through a contractor) contact Participants by any means (including by SMS or e-mail) in the future to provide Participants with information and updates relating to the Promotion (which are generally provided on a weekly basis) or to let Participants know about goods, services or promotions which may be of interest to Participants. The Promoter may also, for these purposes and such other purposes as detailed in Promoter’s privacy statement at fantasytennisleague.com disclose such information to third parties, including related companies, other Australian Tennis Organisations, and parties who provide services to the Promoter. Such third parties may be located overseas. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. By entering the Promotion, Participants consent to their personal information being used in the manner set out above. The Promoter may share Participant information with related companies so that they can contact Participants with offers. By marking the “opt-in” boxes on the Web Site entry form, Participants may consent to the storage and use of their personal information for the marketing purposes as set out next to the opt-in boxes. If you do not agree, you must not provide your personal information, and you will be unable to enter the Promotion. All entries become the property of the Promoter.
  2. Where the Promotion is communicated on Facebook, entrants and participants in the Promotion acknowledge that the Promotion is in no way sponsored, endorsed or administered by or associated with Facebook and entrants and participants in the Promotion release Facebook and its associated companies from all liability arising from the Promotion. Entrants provide their information to the Promoter and not to Facebook.

Discontinuance and Disqualification of Promotion

  1. The Promoter reserves the right to discontinue the Promotion at any time and at its sole discretion may cancel, terminate, suspend or modify the Promotion and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes. Any change to or cancellation of this Promotion, for whatever reason, is subject to applicable law.
  2. Without limiting the foregoing, the Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, can be considered objectionable, profane, potentially insulting, inflammatory or defamatory, or any entrant whose entry is not compliant with these terms or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right in its sole discretion to disqualify and individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.
